Osmaniye 2nd Civil Court of First Instance sentenced the Evrensel newspaper, which brought to the agenda the allegations that Public Prosecutor M.B. threatened the doctor who stated that he could not examine him, to 20 thousand TL compensation in the lawsuit filed by Prosecutor M.B. for “violating his personal rights”. It was alleged that M.B., who applied to the outpatient clinic at Osmaniye State Hospital without any prior MHRS appointment, threatened Orthopedic Specialist Doctor Kemal Gökhan Günel, who was examining a patient inside at the time, and had him detained. Osmaniye Chief Public Prosecutor’s Office initiated an investigation against the doctor on charges of “insult” (TCK 125), and Minister of Justice Abdülhamit Gül gave permission to the HSK to investigate Prosecutor M.B. The process was reported in the April 12, 2021 issue of the newspaper and on the website universal.net. Upon this, M.B. filed a lawsuit against the newspaper for 30 thousand TL compensation. Despite the defense of the newspaper’s lawyer Devrim Avcı that the news article included statements and explanations of all relevant institutions, that there were no statements violating the personal rights of the prosecutor and that there was no defamatory statement in the text of the news article, the compensation claim was partially accepted (December 16).
