The Constitutional Court decided that Orhan Pala’s 2 months and27 days of imprisonment, which is highly severe in terms of ordinary defamation cases as in the present application, inevitably has a chilling effect on the freedoms of expression and press.
The Constitutional Court found that it is a violation of the freedoms of expression and press safeguarded by Articles 26 and 28 of the Constitution and Pala shall be paid compensation of 2 thousand TL (29 March 2017). The file will be sent back to the court which replaced to the 19th Criminal Court of Peace of Istanbul Anatolia.
